  • Stability of Spectrumceuticals probiotics

    All Spectrumceutials probiotics are encapsulated and bottled with an overage (additional active ingredients) above 30 percent to ensure that we meet our regulatory obligations and that our label accurately measures the potency of our formulation for the duration of the product until expiration stored under normal conditions. The most common question we receive regarding our probiotics is; how does temperature variability effect the colon forming unit count (CFU) of the formula during transportation?

    Our probiotics are refrigerated up until they are couriered to your premise. We ship within a fit for purpose polyfoam transport pack (medi-esky) with frozen gel pack providing adequate protection for the probiotics to survive up to 38 degrees Celsius. Typically, the gel pack will be defrosted upon receipt, this should not be a concern.

    Transportation trials on our encapsulated probiotic Pro8-Forte formula within an amber glass bottle packed in a medi-esky with gel pack demonstrate that at 38 degrees Celsius for 72 hours the probiotic activity was still viable above the label claims.

    We dispatch with a completed CN23 form as required by Australian and US Customs.

    The maximum value of any individual purchase is $800 USD that we will ship per order in a given week due to the de minimis value threshold, orders above this value incur US Customs duties and taxes

    1. Pack and Track – is a standard air mail postal service with email parcel tracking, averaging approximately 10 days to the USA.
    2. Track Express – is a premium postal service with email parcel tracking and a faster delivery service, approximately 4 to 6 days depending on your ship to address.

    Products will be at your risk from the time that they are delivered to the address specified by you when placing your order. To the extent permitted by law, Spectrumceuticals Pty Ltd will not be liable for any damage to the products or deterioration in the products after the products are delivered to the address specified by you.

    Returns Policy:

    Unless you notify us within ten (10) days of the receipt of products directly from us under the following conditions you will not receive a refund unless; The products were delivered unfit for resale; or The products are returned to us unopened and in a saleable condition, and: a. they were shipped to you in error; or b. we have expressly agreed to give you a credit.

    A Value Addded Tax (VAT) of 20% may be payable on your order, this is the customers responsibility to pay this amount.

    You’ll be contacted by Royal Mail or Parcelforce explaining how to pay any VAT, duty and fees for dealing with customs. VAT is charged on the total value, including:

    the price paid for the goods
    postage, packaging and insurance
    any duty you owe

    They’ll normally hold your parcel for about 3 weeks. If you haven’t paid the fee by then, it’ll be destroyed or returned to Spectrumceuticals. We will not refund seized or returned parcels.

    Singapore requires an import permit for many goods. Buyers must ensure that they have the necessary permit if required. A Goods and Services Tax of three per cent of the total of cost, insurance, freight and customs duty applies to all goods and merchandise imported into Singapore. It is the customers responsibility to pay this amount to SG Customs, goods maybe held up if payment is not made in cases exceeding this amount.

    Our probiotic supplements and vitamin minerals are considered ‘foods with health claims’.

    Sales Tax:

    There is an 8% consumption tax on all goods imported to Japan. This percentage is calculated on;

    If you don’t pay the tax the shipment may be destroyed or returned to Spectrumceuticals. We will not refund seized or returned parcels.

    Customs Duties:

    All post items sent from overseas that have a customs value of less than 200,000 ($2,300 AUD) must undergo customs inspection. Customs inspection is conducted at branch offices of the Japan Post where a Customs Office for Overseas Mail, etc., of Japan Customs is located.

    If the total tax charges, including customs duty, are less than 10,000 or if duty is more than 10,000 but less than 300,000 for the item and it is requested to be delivered to the recipient, a “Notice of Assessment for International Mail” and the statement of payment (which will also serve as receipt of payment; hereafter the same) will be sent from the customs office through Japan Post Co., Ltd. Because the item will be delivered directly to the recipient, the recipient in question is required to consign duty payment to the Japan Post and pay an amount equivalent to the duty, along with handling charges for the Japan Post (200 per parcel). The item is handed over to the recipient on the spot with payment.

    Freight and Delivery:

    Our orders are dispatched from Sydney, Australia. We ship by Australia Post via their Global Post partnership and contractors.

    We provide two shipping options;

    1. Pack and Track – is a standard air mail postal service with email parcel tracking, averaging approximately 8 to 14 days depending on the destination.
    2. Track Express – is a premium postal service with email parcel tracking and a faster delivery service, approximately 4 to 6 days depending on your ship to address.

    Products will be at your risk from the time that they are delivered to the address specified by you when placing your order. To the extent permitted by law, Spectrumceuticals Pty Ltd will not be liable for any damage to the products or deterioration in the products after the products are delivered to the address specified by you.

    Delivery times mentioned online, in an order confirmation or elsewhere are approximate only and are not of any contractual effect.

    Delivery call backs and no at home are not included in our shipping terms, your local Australia Post affiliated service may charge you additional handling fees if you are not at home at the time of delivery.

    Our probiotics will maintain their full potency for several weeks at room temperature without refrigeration, however we include frozen gel packs during shipment to keep them protected and help prevent exposure to extreme heat during postage. Product will typically arrive at room temperature and even warm depending upon climate, this exposure to heat in the short term will not reduce the stability of the probiotics unless the exposure has been for a number of weeks.

    Returns Policy:

    Unless you notify us within ten (10) days of the receipt of products directly from us under the following conditions you will not receive a refund unless; The products were delivered unfit for resale; or The products are returned to us unopened and in a saleable condition, and: a. they were shipped to you in error; or b. we have expressly agreed to give you a credit.

    We do not refund purchases whereby the customer has failed to pay any USA federal or state taxes or duties to US Customs and the goods have been seized.

    Payment, Tittle, Risk, Property and Ownership:

    Risk in all products lies with you from the time of delivery to you. Title in the goods passes to you when we have received payment for all debts you owe to us. We accept Mastercard or Visa credit card payment via this returned order form and ship only on receipt of payment. We reserve the right to charge a surcharge in respect of payments made by credit card for cost of merchant fees.

    3. Product Descriptions

    1. We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate. Where we become aware of any description in error, we reserve the right to correct any error or omission.
    2. Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product.

    4. Pricing & Ordering

    1. Each order you place is a separate contract, governed by these terms and conditions as amended from time to time.
    2. We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website.
    3. All prices are in Australian Dollars (AUD) and converted to local currency excluding taxes.
    4. When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.
    5. We will accept or reject your order within Five (5) days. If we have not responded to you within Five (5) days, your offer is deemed to be rejected. We are not required to give reasons for rejecting your offer to purchase however the most likely reason for rejecting your offer will be that we do not currently have that product in stock.
    6. You agree to notify us immediately if your business is transferred to another person or company. You agree that unless notification is made, you will be jointly liable with the transferee for any amounts incurred on your account with us after the transfe

Unless contrary to any relevant law, Spectrumceuticals is not liable to you for failure to deliver any products or services by a particular date or dates and any delay in delivery will not extinguish your obligation to accept the products or services or to pay for them.
    3. Our probiotics will maintain their full potency for 28 days at room temperature without refrigeration, however we include cold packs during shipment to keep the probiotics protected and help prevent exposure to extreme heat during postage.

    6.Payment

    1. Risk in all products lies with you from the time of delivery to your specified delivery address.
    2. For patient customers we will not dispatch ordered products until we have received payment in full.

    7. Product Return

    1. Schedule 2 of the Competition and Consumer Act 2010 (“C&C Act”) defines a consumer. Under the C&C Act we are a supplier of goods to you, and as a consumer the C&C Act gives you statutory guarantees.
    2. Schedule 2 of the C&C Act; and those statutory guarantees, all of which are given by us to you if you are a consumer. If you are a consumer within the meaning of Schedule 2 of the C&C Act of our goods then we give you a warranty that at the time of supply of those goods to you, if they are defective then we will replace the goods.

    1. These terms and conditions are to be governed by and construed in accordance with the laws of NSW and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in NSW and you agree to submit to the jurisdiction of those Courts.

If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

    1. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
